ملخص :

تطور القضاء الدستوري بالمغرب من الغرﻓﺔ الدﺳﺘﻮﺭﻳﺔ ﺑﺎﻠمجلس ﺍﻷﻋﻠﻰ منذ 1962 إلى المجلس الدستوري في ﺃﻋﻘﺎﺏ المرﺍﺟﻌﺔ ﺍﻟﺪﺳﺘﻮﺭﻳﺔ ﻟﺴﻨﺔ 1992، قبل دسترة ﺍلمحكمة الدستورية 2011، والتي تم تعيينها في أبريل 2017، حيث أصبحت الجهة المخول لها بسط الرقابة على دستورية القوانين إما وجوبا أو بناء على الإحالة ممن له الصفة وفق المقتضيات القانونية، وإغناء وتقوية المرجعية الحقوقية لمختلف النصوص القانونية عبر وظيفتها الرقابية.

    وتتمثل إشكالية الدراسة في مدى تطور مساهمة القضاء الدستوري بالمغرب في حماية حقوق الإنسان وتعزيزها من خلال رقابة دستورية القوانين بين المجلس الدستوري والمحكمة الدستورية في محورين أساسين:

• اجتهادات المجلس الدستوري في مجال حقوق الإنسان،
• حقوق الإنسان في أعمال المحكمة الدستورية.

حيث بث المجلس الدستوري في ﺍﻟﻌﺪﻳﺪ من القضايا والحاﻻﺕ المرتبطة بمبادئ حقوق الإنسان والحريات المنصوص عليها في الدستور، كمبدأ المساواة وتكافؤ الفرص، حقوق التقاضي والمحاكمة العادلة، الحقوق المدنية والسياسية وحرية الإعلام والحق في المعلومة.

ومواكبة من القضاء الدستوري لديناميتها وخلق قواعد ضمان ممارستها وحمايتها، بعدما استبدل المشرع المجلس بالمحكمة الدستورية، وتحول الرقابة الدستورية من السياسية إلى القضائية؛ فقد تصدت منذ تعيينها إلى عدة نصوص موضوع حماية الحقوق والحريات كحرية الانضمام للجمعيات، حق الملكية، الحق في السكن، حرية الاقتراع، والحقوق اللغوية والثقافية.

Abstract

The evolution of the constitutional judiciary in Morocco from the Constitutional Chamber of the Supreme Council since 1962 to the Constitutional Council following the constitutional review of 1992, before the constitutionality  of Constitutional Court 2011, which was appointed in April 2017 , as it became the authority authorized to extend control over the constitutionality of laws, either obligatory or based on referral from those who have the capacity in accordance with legal requirements , and to enrich and strengthen the legal .reference for the various legal texts through its oversight function.

The problematic of the study is the extent of the evolution of the contribution of the constitutional judiciary in Morocco to the protection and promotion of human rights through the control of the constitutionality of laws between the Constitutional Council and the Constitutional Court in two main axes:

• The jurisprudence of the Constitutional Council in the field of human rights.
• Human rights in the work of the Constitutional Court.

So asthe Constitutional Council broadcasted many issues and cases related to the principles of human rights and freedoms stipulated in the constitution, such as the principle of equality and equal opportunity, the rights to litigation and a fair trial, civil and political rights, freedom of information and the right to information.

The constitutional judiciary kept pace for Constitutional Court dynamism and it create rules to ensure its practice and its protection, after the legislator replaced the Council with the Constitutional Court, and constitutional oversight shifted from political to judicial. Since its appointment, she has addressed several texts on the issue of protecting rights and freedoms, such as the freedom to join associations, the right to property, the right to housing, freedom to vote, and linguistic and cultural rights
