مقدمة : 

تناولت هذه الدراسة أحد أبرز الانتهاكات بحق الشعب الفلسطيني، وتحديداً جرائم الحرب الموثقة بتقرير بعثة الأمم المتحدة لتقصي الحقائق بشأن النزاع في غزة والمسمى إعلامياً “بتقرير جولدستون”، فقد هدفت الدراسة إلى إلقاء الضوء على جرائم الحرب الاسرائيلية المرتكبة خلال فترة العدوان الاسرائيلي على قطاع غزة 2008-2009، وأيضاً إلى توضيح القيمة القانونية لتقرير جولدستون بعدما تراجع القاضي ريتشارد جولدستون عنه في مقالته التي نشرها في جريدة الواشنطن بوست.

وقد تعرضت الدراسة لتوضيح ماهية جرائم الحرب في الفقه الدولي والممارسة الدولية وتبين أن جرائم الحرب هي جميع الأفعال التي ترتكب أثناء النزاع المسلح من قبل المدنيين والعسكريين بالمخالفة للقوانين والأعراف الواردة بالقانون الدولي الإنساني، ثم تناولت بالتفصيل أركان جرائم الحرب المادية والمعنوية، وأيضاً تطرقت للمسئولية الدولية عن جرائم الحرب في القانون الدولي.

كذلك تناولت الدراسة الوضع القانوني لقطاع غزة بعد تطبيق خطة فك الارتباط وتبين أن قطاع غزة لا يزال تحت الاحتلال الاسرائيلي وينطبق عليها قواعد القانون الدولي الإنساني، وتناولت الدراسة أيضاً قواعد السلوك الحربي وتبين أن دولة الاحتلال الاسرائيلي لم تراعي أياً من هذه القواعد خلال عدوانها على قطاع غزة 2008-2009، ثم تطرقت للأحداث خلال فترة العدوان الاسرائيلي وكمية الخسائر الناجمة عن هذا العدوان، ووضحت المسئولية الدولية التي تقع على عاتق المحتل الاسرائيلي إثر هذا العدوان.

وتناولت الدراسة تشكيل بعثة جولدستون ومسار التحقيقات التي قامت بها البعثة، ثم قدمت تصنيف لجرائم الحرب الاسرائيلية التي تناولها التقرير بشكل جديد، وبعد ذلك وضحت مسار تقرير جولدستون في مؤسسات الأمم المتحدة وردود الأفعال عليه، وأيضاً وضحت المسئولية الدولية الملقاة على جميع مؤسسات الأمم المتحدة والمجتمع الدولي كما حددها التقرير.

وأخيراً ناقشت الدراسة إزدواجية تعامل المجتمع الدولي مع دولة الاحتلال الاسرائيلي، وقد توصلت بعد إجراء مقارنة بين تعامل المجتمع الدولي بشأن قضية إقليم دارفور والعدوان الاسرائيلي على قطاع غزة 2008-2009، بأن هذه الإزدواجية تظهر بوضوح في جميع مؤسسات الأمم المتحدة، وتناولت أيضاً القيمة القانونية لتقرير جولدستون بعد تراجع ريتشارد جولدستون منفرداً عن جزء منه، فتبين أن مقالته ليس بمقدورها أن تلغي وثيقة قانونية تبنتها هيئة دولية، فتقرير جولدستون هو نتيجة عمل لجنة كاملة من القانونيين الدوليين.

وناقشت خاتمة الدراسة سبل الاستفادة من قبول عضوية فلسطين في الأمم المتحدة كعضو مراقب في الانضمام إلى محكمة الجنائيات الدولية لملاحقة الاحتلال الاسرائيلي ومقاضاته على جرائم الحرب التي اقترفها بحق الشعب الفلسطيني تطبيقاً لتوصية التقرير محل الدراسة.

Abstract:

This study one of the most prominent Israeli violations against the Palestinian people, specifically Israeli war crimes documented report of the mission of the United Nations Fact Finding Mission on the Gaza Conflict, called the media “the report of the Goldstone”, the study aimed to shed light on Israeli war crimes committed during the period of the Israeli aggression on Gaza Strip 2008-2009, and also to clarify the legal value of the Goldstone report, after declining by Judge Richard Goldstone him in his article published in the Washington Post newspaper.

Has been the study to clarify the nature of war crimes in international jurisprudence and international practice and show that war crimes are all the acts committed during the armed conflict by civilians and military personnel in violation of the laws and customs incoming international humanitarian law, and then dealt with in detail elements for war crimes physical and moral, and also touched on the international responsibility for war crimes in international law.

As well as the study examined the legal status of the Gaza Strip after the implementation of the disengagement plan and found that the Gaza Strip is still under Israeli occupation and the applicable rules of international humanitarian law, The study also conduct the war and found that the State of Israel’s occupation did not take into account any of these rules during its aggression on the Gaza Strip 2008-2009, then touched on the events during the period of the Israeli aggression and the amount of the losses caused by this aggression, and clarified the international responsibility that rests with the Israeli occupier after this aggression.

The study examined the formation of Mission Goldstone and the course of the investigation carried out by the mission, then made a classification of Israeli war crimes addressed in the report in a new way, and then explained the path of the Goldstone report in the United Nations organizations and the reactions it, and also sacrificed international responsibility incumbent upon all United Nations organizations and the international community As identified in the report.

Finally discussed the study double dealing of the international community with the state of the Israeli occupation, has been reached after a comparison between the handling of the international community on the issue of the Darfur and the Israeli aggression on the Gaza Strip 2008-2009, that this duality is evident in all the organizations of the United Nations, also addressed the legal value of the report Goldstone, after the decline of Richard Goldstone solo for part of it, it is clear that his article was not able to cancel a legal document adopted by an international body, Goldstone’s report is the result of the work of the whole international legal.

The conclusion of the study discussed ways to take advantage of the admission of Palestine to the United Nations as an observer member to join the International Court of the criminal prosecution of the Israeli occupation and the prosecution of war crimes committed by the Palestinian people’s right pursuant to the recommendation of the report under consideration.
