الملخص:

تعرف الدول تعديلات دستورية مستمرة بهدف مواكبة التطورات التي تطرأ عليها في مختلف المجالات، وهذه التعديلات هي نتاج لسياقات مختلفة، بعضها مرتبط بالأوضاع الداخلية للدولة فيما يتجاوز البعض الآخر حدود الدولة، ومن نماذج التعديلات التي عرفها المغرب تعديلين دستوريين في سنوات التسعينات (1992 و 1996)، وتعديل دستوري سنة 2011.

وقد جاءت تعديلات سنوات التسعينات في ظروف اتسمت دوليا بسيادة قيم الليبرالية وحقوق الإنسان، ووطنيا بمطالبة الأحزاب السياسية بإصلاحات سياسية وتوسيع هامش الحريات، أما تعديل سنة 2011 فجاء على خلفية أحداث “الربيع العربي” التي عرفتها دول منطقة الشرق الأوسط وشمال افريقيا، التي خرجت على إثرها حركة “20 فبراير” في المغرب للاحتجاج في الشارع، مطالبة بعدد من الإصلاحات على رأسها تعديل الدستور، وهذين السياقين المختلفين جعلا الوثيقتين الدستوريتين لسنوات التسعينات تنصبان أساسا على حقوق الإنسان وإصلاح المؤسسات الدستورية، أما الوثيقة الدستورية لسنة 2011 فاهتمت بحقوق الإنسان و  قضايا الهوية  والملكية البرلمانية، مايدل على تأثير سياق التعديل الدستوري على مضمون الوثيقة الدستورية.

Abstract

Countries undergo continuous constitutional amendments to keep up with developments in various areas, and these amendments come for different contexts, some of which are related to internal state conditions, while others transcend state borders, and two examples constitutional amendments that Morocco had experienced in the 1990s (1992 and 1996), and a constitutional amendment in 2011.

The constitutional amendments of the 1990s took place under conditions characterized at international level by the sovereignty of liberal values ​​and the emergence of human rights discourses, and at national level political parties demanded political reforms and enlargement on the fringes of freedoms, while the constitutional amendment of 2011 took place in the context of the events of the “Arab Spring” which the peoples of the countries of the region of the Middle East and North Africa are protesting over. streets demanding the fall of dispotist regimes. The “February 20” movement in Morocco protested on the street, calling for a number of reforms carried out by amending the constitution, and these two different contexts meant that the constitutional documents of the 1990s mainly focused on human rights. and the reform of constitutional institutions, while the 2011 constitutional document concerned Human Rights and the Parliamentary Monarchy and the question of Moroccan identity, proof that the constitutional amendment is influenced by the national and international political context.
