الملخص

تهدف هذه الورقة إلى توضيح خصوصية الهوية الفلسطينية في الدستور الفلسطيني المقترح. هذه الخصوصية التي ربما تطرح مجموعة من الإشكالات عند محاولة تقنينها؛ بسبب الظروف التي تمر بها القضية الفلسطينية، وبخاصة التباس المرحلة وعدم حسم الخيارات، سواء تجاه التسوية السلمية، أو الكفاح المسلح، أو خيارات الثورة أو الدولة. فكل خيار من هذه الخيارات يؤثر في تعريف الهوية.كما تسعى إلى توضيح الفرق بين مفهوم الهوية في بعدها النضالي عن مفهومها في بعدها الثقافي، والسوسيولوجي، من حيث أن الأول يمكنه توحيد طاقات الشعب الفلسطيني في مواجهة الاحتلال، بينما الثاني قد يثير خلافات وبخاصة في البعد الديني. وقد سعت الورقة للإجابة عن السؤال المركزي التالي: هل حصر الهوية الفلسطينية بنص دستوري يخدم هذه القضية في هذه المرحلة؟وقد استخدم الباحثالمنهج الوصفي التحليلي، من خلال الرجوع إلى الأدبيات المختلفة حول الموضوع، وربطها وتحليلها، وتفسيرها بهدف الوصول إلى نتائج وتعميمات تساعد في فهم الواقع وتحليله. وتوصلت الورقة إلى مجموعة من النتائج أهمها:1. الشعب الفلسطيني يعيش أزمة هوية منذ العام 1948 إن لم يكن قبل ذلك.2. خضع تحديد الهوية الفلسطينية لمتغيرات إقليمية ودولية أكثر مما خضع لمحددات وطنية فلسطينية، كما في الميثاق القومي 1964. بينما في الميثاق الوطني الفلسطيني 1968، ونهوض الوطنية الفلسطينية تمت الإشارة إلى الهوية الوطنية لكن دون قطعها مع الهوية القومية.3. جاء توقيت وضع الدستور الفلسطيني تلبية لرغبات ومطالب خارجية، وليس انعكاسا لحاجة مجتمعية فلسطينية،فقد تأثر مضمونه بطبيعة الظروف والأوضاع السياسية للفلسطينيين: اللاجئين، فلسطينيي الشتات، مؤسسات المنظمة، استحقاقات أوسلو، والاتفاقات الثنائية بين الفلسطينيين والإسرائليين.

Abstract

This paper aims to clarify the specificity of the Palestinian identity in the proposed Palestinian constitution.This privacy may pose a set of problems when trying to legalize it; Because of the circumstances the Palestinian issue is going through, especially the ambiguity of the stage and the failure to resolve the options, whether towards a peaceful settlement, the armed struggle, or the options of the revolution or the state.Each of these options affects the definition of identity. It also seeks to clarify the difference between the concept of identity in its struggle dimension from its concept in its cultural and sociological dimension, in that the first can unify the energies of the Palestinian people in the face of the occupation,While the second may raise differences, especially in the religious dimension.The paper sought to answer the following central question:Does limiting the Palestinian identity to a constitutional text serve this issue at this stage?The researcher used the descriptive and analytical approach, by referring to the various literature on the topic, linking it, analyzing it, and interpreting it in order to reach conclusions and generalizations that help in understanding and analyzing reality.The paper reached a set of results, the most important of which are:1. The Palestinian people have lived through an identity crisis since 1948, if not before.2. The determination of the Palestinian identity has been subject to regional and international variables more than it is subject to Palestinian national determinants, as in the 1964 National Pact. While in the 1968 Palestinian National Pact and the rise of Palestinian nationalism, the national identity was referred to, but without cutting it with the national identity.3.The timing of the creation of the Palestinian constitution came in response to external desires and demands, and not a reflection of a Palestinian societal need, as its content was affected by the nature of the political conditions and conditions of the Palestinian refugees, the Palestinians in the diaspora, the institutions of the organization, the Oslo entitlements, and bilateral agreements between the Palestiniansand the Israelis.
