هدفت البحث للتعرف على طبيعة وحقيقة الأدوار المختلفة التي اضطلعت بها الأمم المتحدة حيال الأزمة اليمنية التي تفاقمت وأصبحت تشكل تهديداً للسلم والأمن تجاوز تأثيره المحيط الوطني بل امتدت آثاره إلى المحيط الإقليمي، من خلال الكشف عن الأزمة اليمنية مسبباتها ومظاهرها ومآلاتها والجهود المبذولة لحلها مع التركيز على دور الأمم المتحدة بأبعاده المختلفة في الأزمة، وطبيعة هذا الدور، وتقييم مدى فاعليته ومساهماته في رأب الصدع بين اليمنيين وإنهاء الأزمة التي أصبحت مهددا لسلامة وأمن الإقليم، بجانب أن الأمم المتحدة هي المنظمة المنوط بها حفظ الأمن والسلم الدوليين في كل دول العالم التي تنضوي تحت لوائها لذلك لابد من التعرف على دورها تجاه الأزمة اليمنية سلباً أو إيجاباً؛ لاسيما في الجوانب الإنسانية والسياسية والحقوقية والأمنية، وتنطلق الدراسة من فرضية مفادها أن منظمة الأمم المتحدة وعبر سياساتها وأدواتها المختلفة فاقمت الأزمة في اليمن، وتكمن أهمية الدراسة في أنها محاولة لتقديم مساهمةلحل الأزمة اليمنية تفيد صناع القرار في اليمن وتعمل على رتق النسيج الداخلي وذلك بتقديم رؤية علمية للخروج من الأزمة المركبة التي يعاني منها اليمن، استخدمت الدراسة المنهج الوصفي التحليلي، والمنهج التاريخي، والمنهج القانوني، ومنهج دراسة الحالة، وقد توصلت إلى أهم النتائج الآتية: إن مواثيق وعهودالأمم المتحدة وإن كانت عالمية المبدأ، لكنهاإنتقايئة التطبيق، وإن قرار العالم مرهون بمزاج الدول الخمس دائمة العضوية، وإن سلوك الأمم المتحدة في اليمن قد ساهم في إطالة الأزمة والحرب وعقَد مسار الحل، وإن ما يجري في اليمن ليس شأناً يمنياً فحسب؛ بل مخطط دولي وإقليمي يستهدف المنطقة العربية بأسرها بصبغة طائفية، وأوصت الدراسة الحكومة الشرعية إعادة النظر في التعامل مع منظمات الأمم المتحدة، والمنظمات الدولية العاملة في اليمن، بما يؤدي إلى الإسهام في خدمة اليمن، وليس الإضرار بمصالحه، كما أوصت الدراسة مؤسسات الأمم المتحدة التعامل مع قضية النزوح والمساعدات الإنسانية بالبعد الإنساني، بعيداً عن التجاذب السياسي، وتفعيل دور الأمم المتحدة في حماية المدنيين، ومعاقبة مرتكبي الانتهاكات، والالتزام بالمرجعيات السياسية للحل في اليمن وعدم تجاوزها، ومراقبة ومنع تسليح الجماعات الخارجة عن القانون في اليمن.

Abstract

The message intended to identify the nature and the truth of the different roles undertaken by the United Nations in respect to the Yemeni crisis.  Moreover,this crisis has escalated and became a threat to peace and safety, the impact of which has not only transcended the national surrounding, but its effects have also exceeded the regional surrounding by uncovering the causes, manifestations and outcomes of Yemeni crisis as well as the efforts made to fix it; furthermore, focusingupon the role of the United Nations in its distinct dimensions in the crisis. Additionally, by revealing the nature of this role and evaluating its effectiveness and contribution in bridging the rift between Yemenis and ending the crisis which has become a threat to the safety and security of the region.  Besides, the United Nations is regarded as the organizationentrusted withmaintaining international peace and security in all countries of the world that fall under its banner for that. It is obligatory to know its role towards the Yemeni crisis either positively or negatively; Especially when it comes to the humanitarian, political, legal and security aspects.  The study is based on the proposition that the United Nations, through its various policies and tools, has exacerbated the crisis in Yemen. In addition, the significance of the study lies in the fact that it is an attempt to present a contribution in solving the Yemeni crisis which goes to the advantage of decision makers and works to mend the internal texture providing a scientific vision to get out of the complex crisis that Yemen suffers from.  Thestudy used the descriptive analytical method, the historical method, the legal method, and the case study method.  It reached the following most important results.  First, the United Nations ‘ pacts and promises, though universally principled, are selective in application.  Second, the world counts on the mood of the five permanent members, the behavior of the United Nations in Yemen has contributed to prolonging the crisis and war and complicating the path to a solution, and that what is happening in Yemen is not only a Yemeni affair, but rather it is an international and regional scheme targeting the entire Arab region with a sectarian overtone.The study recommended the legitimate government (Ashara’iah ) to reconsider dealing with United Nations organizations , and international organizations operating in Yemen , which leads to contributing to the service of Yemen , and not harming its interests.  Furthermore, the study recommended United Nations institutions to deal with the issue of displacement and humanitarian aid in a humanitarian dimension, away from political strife, activating the role of the United Nations in protecting civilians, punishing perpetrators of violations, adhering to the political references for a solution in Yemen and not exceeding them as well as monitoring and preventing the arming of outlaw groups in Yemen.
