الملخص :

يُعد التجديد  لولاية رئيس الجمهورية من المواضيع المهمة والحيوية يتعلق بمركز سيادي مهم في الانظمة السياسية المختلفة لما يشكلة منصب رئيس الجمهورية من أهمية كبرى ضمن المؤسسات الدستورية والسياسية والتي تختلف من نظام سياسي الى نظام سياسي آخر.  اذ يؤدي  التجديد الى تحريك المسؤولية السياسية لرئيس الجمهورية وبالتالي يعد بمثابة وسيلة من الوسائل الرقابية غير مباشرة المؤثرة في سياسة رئيس الجمهورية  .

والمسؤولية  تٌثار   كلما رغب  الرئيس في إعادة ترشيح نفسه لشغل منصب الرئاسة مرة اخرى.   فإذا نال على ثقة الشعب فأنه يتم إعادة إنتخابه , وعلى العكس فانه سوف يستبعد من ذلك الترشيح لولاية اخرى إذا ما بدت لهم جوانب سلبية في إدارة دفة الحكم خلال ولاية سابقة.

إنَ إشكالية الموضوع لا يكمن في تحديد مدة ولاية رئيس الجمهورية بقدر ما يكمن في مدى جواز التجديد من عدمه   اذ تتفق التشريعات الدستورية على إجازة التجديد لولاية ثانية  لرئيس الجمهورية إلا انها تختلف في إطلاق أو تقييد مدة ولاية رئيس الجمهورية من عدمه وهذا الامر يتوقف على الفلسفة السياسية التي تتبعها في تحديد نظامها السياسي .   ومسألةالتجديد يتأثر بعدد معايير يتعلق بطريقة اختيار رئيس الجمهوريةوطبيعة نظام الحكم ونوع النظام السياسي .

ويعد من أهم التوصيات المقدمة  عدم جعل التجديد مطلقاً  كون ذلك يتنافى مع الانظمة الرئاسية نظراً للدور المؤثر في الحياة السياسية , كذلك  ضرورة النص في التشريعات الدستورية بعدم إجراء إي تعديلات دستورية من شأنها تمديد ولاية رئيس الجمهورية لمدة زمنية أطول لما هو منصوص عليه في الدساتير .

Abstract

The renewal of the Mandate of the President of the Republic is one of the important and vital issues related to an important sovereign position in the various political systems, as the position of the President of the Republic is of great importance within the constitutional and political institutions, which differ from one political system to another. As the renewal leads to the movement of the political responsibility of the President of the Republic and thus is considered as a means of indirect control affecting the policy of the President of the Republic.

Responsibility arises whenever the president wishes to re-run for office. If he gains the confidence of the people, he will be re-elected, and on the contrary, he will be excluded from that nomination for another term if they seem to have negative aspects in the administration of government during a previous term.

The problem of the subject does not lie in determining the term of office of the President of the Republic as much as it lies in the extent to which it is permissible to renew or not, as constitutional legislation agrees to authorize renewal for a second term of the President of the Republic, but it differs in the release or restriction of the term of office of the President of the Republic or not, and this matter depends on the political philosophy that it follows in determining its political system. The issue of renewal is influenced by a number of criteria related to the method of selecting the President of the Republic, the nature of the system of government and the type of political system.

One of the most important recommendations made is not to make renewal at all as this is incompatible with the presidential systems due to the influential role in political life, as well as the need to stipulate in constitutional legislation not to make any constitutional amendments that would extend the term of the President of the Republic for a longer period of time than what is stipulated in the constitutions.
