لقد تم اختيارنا لموضوع الدراسة نظراً لأهميته الكبيرة لأنه موضوع يتعلق ببناء المؤسسات الدستورية وتعزيز دور القانون من جانب، ومن جانب آخر فإنه يتعلق بحقوق الافراد وكيفية الحفاظ عليها عن طريق مؤسسات الدولة الدستورية، وقد سلكنا المنهج الوصفي التحليلي المقارن ، أما عن تقسيم دراستنا فقد تضمنت ستة فصول، تناولنا في الفصل الأول الإشكاليات والمقاربات المنهجية والدراسات السابقة، حيث ناقشنا عدة دراسات في الإطار العام لموضوع بحثنا وعرفنا مصطلحات البحث تعريفاً وافياً وتفصيلياً، وبينا الحدود الزمانية والمكانية للدراسة، مع استعراض لاهداف وفرضيات البحث و اشكالياته، أما الفصل الثاني فتناولنا فيه ماهية النظم السياسية، وبينا مفهومها فعرفناها وبينا أنواعها، وفي الفصل الثاني ايضاً تطرقنا الى الأحزاب السياسية فبينا مفهومها وماهي اصنافها ومدى تأثيرها على طبيعة النظام السياسي ودورها في فاعليته، وبعد ذلك تناولنا بالبحث النظم الانتخابية وتطرقنا الى تعريفها وانواعها ومدى تأثيرها على طبيعة النظام السياسي، أما الفصل الثالث فكان البحث فيه يدور حول الرقابة على دستورية القوانين ومفهومها وأنواعها والأساليب التي تمارس فيها ومدى فاعلية كل منها، وبحثنا في كيفية تشكيل كل نوع من أنواع الرقابة الدستورية، اما الفصل الرابع فتناولنا فيه الأثر الذي تفرضه طبيعة النظام السياسي على الرقابة الدستورية، وما هو دور النظام السياسي في التأثير في مدى فاعليتها، وبحثنا في الدور التشريعي في تفعيل المؤسسات التي تمارس دور الرقابة على دستورية القوانين، وبعد ذلك تناولنا في الفصل الخامس المراحل التي مرت بها الرقابة على دستورية القوانين في العراق، وبحثنا في كيفية تشكيل المحاكم الدستورية في العراق، وتناولنا اختصاصاتها ومدى حجية قراراتها، ومن ثم بحثنا في العوامل السياسية التي لها الأثر على فاعلية الرقابة الدستورية، وتناولنا بالبحث أيضا مجلس الاتحاد وكيفية تشكيله والعوامل التي أدت الى عدم فاعليته وتناولنا ايضاً دور المحاصصة والتوافقات السياسية وأثرها على الرقابة الدستورية ومن ثم بينا ماتوصلنا اليه من نتائج خلال البحث وما ارتأيناه من توصيات في الفصل السادس والأخير

Abstract

The subject has been selected for this study because of its great importance as this topic relates to the construction of constitutional institutions and powering the strengthening of the role of law. Also, it concerns the rights of individuals and how to preserve them through the constitutional institutions of the State. The descriptive-analytical and comparative approach, in addition to the historical, scientific approach in some of the resources of the research, have been used as a methodology of this study. This study has been divided into six chapters. In the first chapter, the methodologies and approaches of the previous studies have been discussed; where there are discussions of several studies in the general framework of this research field, then there is a definition of the search terms in a detailed manner. The temporal and spatial limits of this study with a review of the objectives, hypotheses and problems of the research have been explained as well. The second chapter dealt with the definition of political systems, the explanation of their concept, identifying their types and explaining the historical side of their origins and genesis. The political parties are the second topic in chapter two as there is a discussion of the concept of the political parties, their categories and the extent of their impact, role and effectiveness on the nature of the political system. Then, the concept of the electoral system has been clarified. The types of electoral systems have been discussed and the extent of their impact on the nature of the political system as well. The third chapter was about the concept of the constitutional review, its types and the methods in which they are practised and the effectiveness of them. There is also a discussion of how each type of constitutional review was formed. The fourth chapter deals with the impact imposed by the nature of the political system on the constitutional review. What is the role of the political system in influencing its effectiveness, and what is the legislative role in activating the institutions that exercise the constitutional review? In Chapter five: The phases of controlling the constitutional review in Iraq have been explained then discussed how constitutional courts are formed in Iraq and their terms of reference and the authenticity of their decisions. There is a discussion of the political factors that have an impact on the effectiveness of the constitutional review in Iraq. Also, there is an identification of the Federation Council and how it was formed and the factors that led to its ineffectiveness. Then the role and impact of sectarian quotas and political consensus on the constitutional review have been explained. In this study, there is an opinion poll on the role and effectiveness of the Iraqi Federal Supreme Court has been conducted, then a statistic on the number of decisions of the Federal Supreme Court regarding constitutional appeals has been conducted as well. Thus, my findings during this study and the recommendations that I think would be useful have been listed in Chapter six: also there are some appendices, which included some statistics, tables and some of the laws, have been listed during the chapters of this study.
