الملخص :

من المتعارف عليه أن الإدارة عندما تمارس نشاطاتها تهدف إلى تحقيق أهداف محددة، وتتمحور هذه النشاطات في القرارات الإدارية والعقود الإدارية؛ وجانب دراستنا متعلق بالقرارات الادارية؛ من حيث دراسة شروط إبطال القرار الإداري الغير مشروع أمام القضاء الإداري الفلسطيني. وبناءً على ما تقدم سيتم تقسيم الدراسة على النحو الاَتي في المبحث الأول الشروط المتعلقة بمحل الدعوى ورافع الدعوى حيث أننا سنتناول فيه التعريف والأركان والخصائص المتعلقة في محل الدعوى وكذلك المتعلقة برافع الدعوى ، وفي المبحث الثاني سنبين الشروط المتعلقة بميعاد الطعن وانعدام الطعن الموازي حيث أننا قسمنا هذا المبحث الى مطلبين الأول يبين الشروط المتعلقة بميعاد الطعن بالإلغاء من حيث البدء والاحتساب وتجاوز الميعاد وأثر انتهائه بينما شمل المطلب الثاني بالشروط المتعلقة بانعدام الطعن الموازي  ، ولقد توصل الباحث إلى العديد من النتائج والتوصيات ، حيث أن من أهم النتائج هي أن دعوى الإلغاء هي دعوى إدارية يجب أن يكون أحد أطرافها بصفة دائمة الإدارة حتى يتم الطعن بها أمام القضاء الإداري ، بينما كان من أهم التوصيات أنه يتعين على المشرع الفلسطيني إضافة وسيلة العلم اليقيني الى وسيلتي  التبليغ والنشر كون أن الهدف من الطعن في القرار الإداري هو معرفة الطاعن بالقرار الذي قد يشكل ضرر حقيقي أو محتمل .

Abstract

It is known that the administration, when it exercises its activities, aims to achieve specific goals, and these activities center in administrative decisions and administrative contracts; The aspect of our study is related to administrative decisions; In terms of studying the conditions for annulment of the illegal administrative decision before the Palestinian administrative court. Based on the foregoing, the study will be divided as follows in the first section, the conditions related to the place of the case and the claimant, where we will address the definition, elements and characteristics related to the place of the case as well as those related to the claimant, and in the second section we will show the conditions related to the date of the appeal and the absence of a parallel appeal, as we divided this The topic includes two demands, the first shows the conditions related to the date of the appeal for cancellation in terms of starting, calculating, exceeding the date and the effect of its end, while the second requirement included the conditions related to the absence of a parallel appeal, and the researcher reached many results and recommendations, As one of the most important results is that the annulment lawsuit is an administrative lawsuit that one of the parties to it must be permanently the administration until it is challenged before the administrative court, while one of the most important recommendations was that the Palestinian legislator should add the means of certain knowledge to the means of notification and publication, since the objective of the appeal In the administrative decision, it is the appellant’s knowledge of the decision that may constitute real or potential harm.
