الملخص:

إن للمجلس الدستوري الجزائري عدة صلاحيات خولها له المؤسس الدستوري بموجب أحكام الدستور، وعلى رأسها الرقابة على دستورية القوانين والتي تهدف إلى التأكد من أن كل القوانين التي يصدرها البرلمان أو السلطة التنفيذية مطابقة لأحكام الدستور، والمجلس الدستوري الجزائري يمارس رقابته على دستورية المعاهدات الدولية والقوانين والتنظيمات بموجب رأي، كما يبدي رأيه وجوبيا بإخطار من رئيس الجمهورية حول دستورية القوانين العضوية بعد أن يصادق عليها البرلمان، ويفصل في مطابقة النظام الداخلي لغرفتي البرلمان بنفس الإجراءات، ومن بين الصلاحيات التي خولها أيضا الدستور للمجلس الدستوري الجزائري هي السهر على صحة الانتخابات ، حيث أنه طبقا لأحكام القانون العضوي رقم 16- 10، والمتعلق بنظام الانتخابات، فإن أول مرحلة من مراحل رقابة المجلس الدستوري على صحة العملية الانتخابية هي فحص مدى تطابق ملفات المترشحين في الانتخابات الرئاسية مع شروط الترشح للانتخابات التي حددها الدستور والقانون المتعلق بالانتخابات، والإعلان عن نتائج الانتخابات في الانتخابات التشريعية، إلا أن المجلس الدستوري الجزائري يمارس رقابته على العملية الانتخابية قبل هذه المرحلة، وهذا بمناسبة الرقابة على دستورية القانون المتعلق بالانتخابات.

Abstract:

The Algerian Constitutional Council has several prerogatives which are attributed to it by the constitutional founder in virtue of the provisions of the Constitution, including the control of the constitutionality of laws, These prerogatives are incarnate by confirming that all the texts of law emanating from the parliament and the executive power are conforming to the provisions of the Constitution.

The Constitutional Council decided, by an opinion, on the constitutionality of treaties, laws and regulations, this last notified by the President of the Republic, express an obligatory opinion on the constitutionality of the organic laws after their adoption by the parliament and it decided also in the same forms, on the conformity with the constitution of the internal regulation of each of the two chambers of parliament.

Among the prerogatives assigned to the Constitutional Council, in accordance with the provisions of the constitution, is to watch over the correction of the elections, and this in accordance with the provisions of the election law, although the first step that the Constitutional Council proceeds to control in the elections in conformity with the organic law 16-10, related to the electoral system, is to confirm that the files of candidacy in presidential elections are conform to the specific conditions of the constitution and the electoral law and the announcement of the results of the legislative elections, the constitutional council must practice a prior Control on the elections by controlling the constitutionality of the law elections.
